F.I.F.A. - Camera di Risoluzione delle Controversie (2004-2005) - indennità di formazione - versione non ufficiale by dirittocalcistico - Decisione della Camera di Risoluzione delle Controversie a Zurigo, in Svizzera, il 22 luglio 2004, nella seguente composizione: Slim Aloulou (Tunisia), Presidente Gerardo Movilla (Spagna), membro Michele Colucci (Italia), membro Jean-Marie Philips (Belgio), membro Mario Gallavotti (Italia), membro sulla domanda presentata dal Club A, come attore contro il Club B, in quanto rispondente per quanto riguarda la formazione compensazione per i fatti C. giocatore del caso C è nato il 10 febbraio 1983. Una aveva un contratto di lavoro scritto con il giocatore del 19 dicembre 2002, valida tra il 7 gennaio e il 20 novembre 2003, che è stato automaticamente prorogato fino alla data in cui è conclusa la sua partecipazione alla fase finale del secondo torneo, che secondo B (questa non sono mai stati fatti negata da A), avvenuta il 20 dicembre 2003. Il 30 gennaio 2004, C e B ha firmato un contratto di lavoro. A chiede di essere compensato dalla B per un importo di USD 800.000, per i costi sostenuti in cui con la formazione del giocatore e l'istruzione. B riconosce che A ha diritto a ricevere l'indennità di formazione in materia presente. A l'Associazione ha informato l'Amministrazione FIFA che C è stato registrato per A dal dicembre 1995 fino al 10 gennaio 2004, con l'eccezione del periodo compreso tra il 1 ° gennaio e 19 dicembre 2002, durante la quale was_registered per considerazioni D. della Camera di Risoluzione delle Controversie In conformità con l'art. 42 par. 1 lit. (B) (iv) del nuovo Regolamento FIFA sullo status e sul trasferimento dei giocatori, rientra nella competenza della Camera di Risoluzione delle Controversie di esaminare le controversie concernenti la tassa di compensazione di formazione. Di conseguenza, la Camera di Risoluzione delle Controversie è l'organo competente a decidere sul contenzioso in esame, concernente la presunta violazione del contratto tra l'attore e il convenuto. Una volta che la sua competenza è stato così stabilito, la Camera di Risoluzione delle Controversie ha continuato a trattare il merito della causa. La Camera ha riconosciuto che C erano stati addestrati e sviluppata da A, dal dicembre 1995 fino al 1 ° gennaio 2002 e dal 19 dicembre 2002 fino al 10 gennaio 2004. Inoltre, come stabilito nella Circolare n. 826, del 31 ottobre 2002, l'indennità di formazione è dovuta per la formazione sostenute età compresa tra i 12 e 21, se il giocatore non conclude un dilettante contratto prima all'età di 23 anni. Prendendo in considerazione il suddetto periodo di soggiorno con il richiedente, la Camera ha ritenuto che lo sviluppo positivo del giocatore deve essere attribuito principalmente alla formazione e istruzione che ha ricevuto da A. Di conseguenza, è pacifico che A ha diritto a ricevere un risarcimento da B per la formazione e l'istruzione di C per quanto riguarda il lasso di tempo che il giocatore trascorso con esso. Tuttavia, la Camera ha ritenuto che l'importo richiesto da A è stato eccessivo e non motivato e deciso di calcolare l'indennità di formazione sulla base degli importi indicativi elencate nella predetta lettera circolare. Inoltre, ai sensi dell'art. 5.1 del Regolamento dei regolamenti sullo status e il trasferimento dei calciatori, ai fini del calcolo della compensazione, il periodo di formazione pertinente comincia all'inizio della stagione e si conclude alla fine della stagione in questione. Nel caso di specie, la Camera sottolineato che il periodo di formazione importante da prendere in considerazione è passato dalla stagione sportiva 1996, quando il giocatore aveva 13 anni, fino alla stagione sportiva 2001, all'età di 18 anni, così come la stagione sportiva 2003, quando il giocatore era di 20. In conformità con i principi per il calcolo degli importi di compensazione di allenamento, previsto nuovo Regolamento FIFA sullo status e sul trasferimento dei giocatori e nella lettera citata circolare, la categoria della società di provenienza e l'importo corrispondente alla stessa categoria nel nuovo Confederazione club UEFA, che è nel caso di specie, si applicano. Di conseguenza, tenendo conto del fatto che A è un club di prima divisione appartenente alla categoria 3 in Sud America, 10.000 euro (importo indicativo per anno, per la categoria 4 in Europa) è concesso per ciascuna delle prime due stagioni che il giocatore trascorso con A e 30.000 euro (importo indicativo per anno, per la categoria 3 in Europa) è concesso per ciascuno dei restanti cinque stagioni. In considerazione di quanto sopra, la Camera di Risoluzione delle Controversie deciso che B è tenuto a versare l'importo complessivo di euro 170.000 ad A per l'indennità di formazione della decisione C. della Camera di Risoluzione delle Controversie 1. B deve pagare l'importo di euro 170.000 a A. 2. L'importo dovuto alla A deve essere pagato da B entro 30 giorni dalla data di notifica della presente decisione. 3. Se B non riesce a rispettare il suddetto termine, un tasso di interesse del 5% all'anno si applica. 4. Inoltre, se la somma di cui sopra non viene pagata entro il termine suddetto, la presente questione deve essere presentata alla commissione disciplinare della FIFA, in modo che le necessarie sanzioni disciplinari possono essere imposte. 5. Tale decisione può essere impugnata dinanzi alla Corte di Arbitrato per lo Sport (CAS), ai sensi dell'art. 60 par. 1 dello Statuto FIFA. La dichiarazione di ricorso deve essere inviato direttamente al CAS entro 10 giorni dal ricevimento della notifica della presente decisione e deve contenere tutti gli elementi di cui al punto 2 delle direttive impartite dal CAS, copia della quale si allega alla presente. Entro altri 10 giorni successivi alla scadenza del termine per la presentazione della dichiarazione di ricorso, la ricorrente deve depositare presso la CAS una breve indicazione dei fatti e argomenti giuridici che danno origine al ricorso (cfr. punto 4 delle direttive). Facts of the case C was born on 10 February 1983. A had a written employment contract with the player dated 19 December 2002, valid between 7 January and 20 November 2003, which was automatically extended until the date when A ended its participation in the final phase of the second tournament, which according to B (this facts were never denied by A), happened on 20 December 2003. On 30 January 2004, C and B signed an employment contract. A requests to be compensated by B in the amount of USD 800,000, for the costs in which it incurred with the player’s training and education. B acknowledges that A is entitled to receive training compensation in the present matter. A’s Association informed the FIFA Administration that C has been registered for A from December 1995 until 10 January 2004, with the exception of the period between 1 January and 19 December 2002, during which he was_registered for D. Considerations of the Dispute Resolution Chamber In accordance with Art. 42 par. 1 lit. (b) (iv) of the revised FIFA Regulations for the Status and Transfer of Players, it falls within the purview of the Dispute Resolution Chamber to review disputes concerning training compensation fees. Consequently, the Dispute Resolution Chamber is the competent body to decide on the present litigation concerning the alleged breach of contract between the claimant and the respondent. Once its competence was thus established, the Dispute Resolution Chamber went on to treat the substance of the case. The Chamber acknowledged that C had been trained and developed by A, from December 1995 until 1 January 2002 and from 19 December 2002 until 10 January 2004. Moreover, as established in Circular letter no. 826, dated 31 October 2002, training compensation is payable for training incurred between the ages of 12 and 21, if the player concludes a non-amateur contract before the age of 23. Taking into consideration the aforementioned period of stay with the claimant, the Chamber considered that the player’s positive development has to be mainly attributed to the training and education that he received from A. Consequently, it is undisputed that A is entitled to receive from B compensation for the training and education of C with regard to the timeframe that the player spent with it. However, the Chamber considered that the amount claimed by A was excessive and not motivated and decided to calculate training compensation on the basis of the indicative amounts listed in the aforementioned Circular letter. Furthermore, according to Art. 5.1 of the Regulations governing the Regulations for the Status and Transfer of Players, for purposes of calculating compensation, the relevant training period starts at the beginning of the season and ends at the end of the season concerned. In the present matter, the Chamber outlined that the relevant training period to take into consideration went from the sporting season 1996 when the player was 13, until the sporting season 2001, at the age of 18, as well as the sporting season 2003, when the player was 20. In accordance with the principles for calculation of the training compensation amounts, stipulated in the revised FIFA Regulations for the Status and Transfer of Players and in the aforementioned Circular letter, the category of the former club and the amount corresponding to the same category in the new club’s Confederation which is UEFA in the present case, apply. As a consequence, taking into account the fact that A is a first division club belonging to Category 3 in South America, EUR 10,000 (indicative amount per year, for category 4 in Europe) is granted for each of the first two seasons that the player spent with A and EUR 30,000 (indicative amount per year, for category 3 in Europe) is granted for each of the remaining five seasons. In view of all the above, the Dispute Resolution Chamber decided that B is liable to pay the total amount of EUR 170,000 to A for the training compensation of C. Decision of the Dispute Resolution Chamber 1. B has to pay the amount of EUR 170,000 to A. 2. The amount due to A has to be paid by B within 30 days as from the date of notification of this decision. 3. If B fails to comply with the above-mentioned deadline, an interest rate of 5% per year will apply. 4. Moreover, if the aforementioned sum is not paid within the aforementioned deadline, the present matter shall be submitted to the FIFA’s Disciplinary Committee, so that the necessary disciplinary sanctions may be imposed. 5. This decision may be appealed before the Court of Arbitration for Sport (CAS) in accordance with art. 60 par. 1 of the FIFA Statutes. The statement of appeal must be sent to the CAS directly within 10 days of receiving notification of this decision and has to contain all elements in accordance with point 2 of the directives issued by the CAS, copy of which we enclose hereto. Within another 10 days following the expiry of the time limit for the filing of the statement of appeal, the appellant shall file with the CAS a brief stating the facts and legal arguments giving rise to the appeal (cf. point 4 of the directives).
