I. Fatti all'origine della controversia 1. Il 10 settembre 2008, l'agente di calciatori T (in prosieguo: il Richiedente), autorizzato dalla Federazione di calcio H, e il giocatore S (in prosieguo: il Resistente) hanno concluso un accordo di rappresentanza (in prosieguo: l 'accordo), valido a partire dalla data della firma fino al 10 settembre 2010. 2. L'articolo 1 della convenzione prevedeva che il Resistente assegnato l'attore "come suo unico rappresentante, delegato e consulente per il paese G e all'estero e rappresenta lo responsabili della negoziazione e la gestione per conto di qualsiasi tipo di gesto atletico ...". L'articolo 5 della convenzione prevedeva inoltre che "[I] l 'autorizzazione e di comando, che è fornito al Gestore [vale a dire l'] richiedente è esplicito ed esclusivo ". 3. Inoltre, l'articolo 7 del contratto, a condizione che "[F] o il servizio complessivo fornito dal Gestore [cioè il] attore, si è convenuto che ha diritto con l'importo del 10% del dell'Atleta [cioè il Resistente] reddito annuo lordo, per effetto del contratto di accordo che il Gestore ha negoziato per importi pari o superiori a 100.000 euro ", considerando che l'articolo 8 del contratto prevedeva che" Il pagamento di quanto dovuto al Gestore, tramite un contratto o dai diritti di finanziamento, deve essere elaborato su dieci (10) giorni a partire dagli atleti giorno riceve un pagamento ". 4. Il 2 marzo 2011, l'attore ha presentato una domanda di fronte FIFA contro il convenuto spiegando che, il 23 febbraio 2009, dopo lunghe trattative l'attore era che sarebbero state condotte con il paese G club di P (in prosieguo: il club di P) per conto di il Resistente, il contratto di lavoro datato 29 agosto 2007, dal titolo "contratto di giocatore professionista" tra il club e il convenuto è stato modificato e un nuovo contratto di lavoro dal titolo "Accordo per la modifica del contratto di giocatori professionisti" del 23 febbraio 2009 è stato concluso e firmato dal club, il Resistente e l'Attore. Secondo la ricorrente, nonostante i numerosi tentativi di contattare il convenuto, al fine di ricevere la sua presunta commissione concordata per i suoi servizi, non aveva ricevuto alcun importo. 5. Di conseguenza, l'attore ha chiesto da parte al Resistente l'importo di euro 74.909, che rappresenta, secondo lui, il 10% di tutti i pagamenti lordi ricevuti dal convenuto per il periodo dal 23 febbraio 2009 fino al 22 febbraio 2011. Il richiedente ha inoltre chiesto al convenuto di pagare un interesse di mora sull'importo detto ad un tasso del 5%. 6. Il 1 ° luglio 2011, l'attore modificato la sua domanda e ha spiegato che il Resistente aveva guadagnato i seguenti importi in quanto il contratto di lavoro con la società era stata modificata: A. Per il periodo dal 23 febbraio 2009 fino al 30 giugno 2009: rate: EUR 47.065 Firma -sul prezzo: EUR 139.594 bonus di partecipazione: 66.992 EUR Totale parziale: EUR 253.651 B. Per il periodo dal 1 ° luglio 2009 al 30 giugno 2010: rate: EUR 275.470 bonus di partecipazione: 126904 EUR Totale parziale: EUR 402.374 C. Per il periodo dal 1 ° luglio 2010 fino al 4 gennaio 2011: rate: EUR 153.621 Totale parziale: EUR 153.621 TOTALE: EUR 809.646 7. Sulla base di quanto sopra, l'attore ha chiesto da parte del Resistente la somma di euro 80.964, che corrisponde al 10% del reddito lordo del Resistente. 8. A dispetto di essere stato invitato a farlo, il Resistente non ha risposto al ricorso presentato contro di lui, anche se è stato informato che, in assenza di una risposta, la decisione sarebbe stata presa sulla base delle informazioni e delle prove a disposizione. 9. Il 14 giugno, l'attore ha informato FIFA che non voleva presentazione di eventuali osservazioni in materia in gioco e ha chiesto che il caso sia sottoposto al Commissione per lo Status dei Calciatori per una decisione formale. 10. I termini esatti finanziari della "Accordo per la modifica del contratto di giocatori professionisti" del 23 febbraio 2009 e fornite dal ricorrente sono i seguenti: "Per il periodo che va dalla firma del presente accordo fino al 30.06.2012 il giocatore riceve l'importo complessivo di euro 815.000 in 14 rate, come segue ": 20.000 euro da pagare in data 28 febbraio 2009; 20.000 euro pagabile il 30 maggio 2009; EUR 56.250 pagabile il 30 settembre 2009; EUR pagabile il 30 novembre 2009 56250; EUR 56.250 pagabile il 28 febbraio 2010; EUR pagamento il 30 maggio 2010 56250; EUR pagabile il 30 settembre 2010 62500; EUR pagabile il 30 novembre 2010 62500; EUR pagabile il 28 febbraio 2011 62500; EUR pagamento il 30 maggio 2011 62500; EUR 75.000 pagabile il 30 settembre 2011 , EUR 75.000 pagabile il 30 novembre 2011; EUR 75.000 pagabile il 28 febbraio 2012; EUR 75.000 pagabile il 30 maggio 2012. "Per la stagione calcistica 2008-2009, se il giocatore partecipa a partite ufficiali del club (Campionato, Coppa, Champions League del paese G) per oltre il 60% avrà diritto a ricevere l'importo di 50.000 euro come bonus. Se partecipa a partite ufficiali del club, dal 30% al 60%, avrà diritto a ricevere un ammontare proporzionale dell'utile 50.000 euro ". "Per ogni stagione calcistica 2009-2010 e 2010-2011, se il giocatore partecipa a 20 partite ufficiali del paese G Campionato, Champions League e Coppa UEFA, avrà diritto a ricevere l'importo di euro 100.000". "Per la stagione calcistica 2011-2012, se il giocatore partecipa a 20 partite ufficiali di Campionato, Champions League e Coppa UEFA del paese G, avrà diritto a ricevere l'importo di 150.000 euro". 11. Inoltre, il contratto di lavoro stipulato che gli "importi corrispondenti bonus sarà versato entro il termine di due (2) mesi dalla fine della stagione calcistica di ogni anno". Infine, il contratto prevedeva inoltre che "Il giocatore riceverà l'importo di euro 110.000 come compenso per la firma del contratto, modifiche, entro 3 giorni dalla firma del presente". II. Considerazioni del giudice unico di lo Status dei Calciatori Comitato 1. Prima di tutto, il giudice unico delle Commissione per lo Status dei Calciatori (di seguito indicato anche come: il giudice unico), che ha analizzato le norme di procedura si applicano al caso di specie. A questo proposito, il giudice unico di cui all'art. 21 par. 2 e 3, del regolamento che disciplinano le procedure di Commissione per lo Status del Calciatore e della Camera di Risoluzione delle Controversie (edizione 2008). La questione attuale è stato presentato alla FIFA il 2 marzo 2011, quindi dopo il 1 ° luglio 2008. Pertanto, il giudice singolo ha concluso che l'attuale edizione delle norme procedurali (edizione 2008, in prosieguo: le norme procedurali) è applicabile alla materia in mano. 2. Successivamente, il giudice unico ha analizzato l'edizione del Regolamento agente di calciatori FIFA dovrebbe applicarsi. A questo proposito, il giudice unico ha confermato che ai sensi dell'art. 39 paragrafo. 1 e 4 della edizione 2008 di giocatori Regolamento Agenti, e considerando che la presente domanda è stata presentata il 2 marzo 2011, l'edizione attuale di giocatori Regolamento Agenti (edizione 2008, in prosieguo: il Regolamento) è applicabile in materia in gioco. 3. Per quanto riguarda la sua competenza, il giudice unico del Comitato per lo Status dei Calciatori ha sottolineato che ai sensi dell'art. 30 par. 2 del Regolamento, la FIFA è competente a conoscere delle controversie internazionali in connessione con le attività degli agenti dei giocatori, vale a dire persone fisiche in possesso di un valido giocatori 'licenza di agente rilasciata dalle Associazioni membri interessati. 4. Il giudice unico ha continuato i suoi lavori indicando che la questione in esame riguarda una controversia tra un agente di calciatori autorizzato dalla Federazione di calcio H e un giocatore, per quanto riguarda una presunta commissione straordinaria. Di conseguenza, il giudice unico della Commissione per lo Status dei Calciatori è l'organo competente a decidere sulla questione attuale che ha una dimensione internazionale. 5. La sua competenza e le norme vigenti che sono stati istituiti, ed entrando nel merito della questione presente, il giudice singolo ha iniziato riconoscendo i fatti accertati del caso di specie, nonché i documenti contenuti nel file. A questo proposito, il giudice unico ha osservato che, il 10 settembre 2008, l'attore e il convenuto è stato concluso un accordo in base al quale quest'ultima aveva accettato di pagare al primo una commissione del 10% del suo reddito annuo lordo nel caso in cui il Richiedente negoziato un contratto per conto del convenuto per gli importi "pari o superiore a 100.000 euro". 6. Allo stesso modo, il giudice unico ha riconosciuto che contratto di lavoro del giocatore con il club è stato modificato il 23 febbraio 2009 e che l'attore aveva firmato contratto di lavoro ha detto come l'agente del giocatore e aveva quindi agito per suo conto. 7. Inoltre, il giudice unico ha riconosciuto che, nella sua affermazione modificata alla FIFA, l'attore aveva richiesto il pagamento del 10% del reddito annuo lordo del Resistente fino al 4 gennaio 2011, sostenendo che il convenuto non aveva pagato la commissione competente a seguito di accordo . 8. In seguito, il giudice unico ha anche sottolineato che il Resistente non ha presentato osservazioni in risposta al ricorso presentato contro di essa dalla parte attrice. Di conseguenza, il giudice unico ha ritenuto che, agendo in questo modo, il convenuto aveva rinunciato al suo diritto di difesa e che doveva quindi ritenere che il convenuto aveva accettato le accuse di parte attrice. 9. Inoltre, e tenendo conto che il club e il convenuto aveva modificato il loro rapporto di lavoro il 23 febbraio 2009, per un importo superiore a 100.000 euro, il giudice unico ha ritenuto che le condizioni per il pagamento delle commissioni del richiedente ai sensi dell'accordo erano state così soddisfatte. 10. Tenendo presente quanto sopra esposto e in conformità con il principio fondamentale del diritto del pacta sunt servanda, che in sostanza significa che gli accordi devono essere rispettati dalle parti in buona fede, il giudice unico ha ritenuto che in base all'accordo concluso tra le parti, il Resistente aveva accettato di pagare per remunerare il richiedente per i suoi servizi. 11. Alla luce di quanto sopra, il giudice unico giunto alla conclusione che l'attore dovrebbe avere il diritto di ricevere una remunerazione del 10% dei pagamenti di base lordo percepito dal convenuto. 12. Avendo stabilito quanto sopra, il giudice unico ha continuato a calcolare l'importo esatto da pagare da parte del Resistente al richiedente a titolo di corrispettivo, sulla base del contratto. 13. A questo proposito, il giudice unico ha riconosciuto il fatto che la modifica del contratto di lavoro concluso tra il Resistente e il club il 23 febbraio 2009 ha stabilito che il convenuto avrebbe dovuto ricevere, "per il periodo compreso tra la firma del presente accordo fino al 30 giugno 2012 ", la quantità totale di 815.000 euro in 14 rate: 20.000 euro da pagare in data 28 febbraio 2009; 20.000 euro pagabile il 30 maggio 2009; EUR 56.250 pagabile il 30 settembre 2009; EUR 56.250 pagabile il 30 novembre 2009; 56.250 euro da pagare in data 28 febbraio 2010; EUR pagamento il 30 maggio 2010 56250; EUR pagabile il 30 settembre 2010 62500; EUR pagabile il 30 novembre 2010 62500; EUR pagabile il 28 febbraio 2011 62500; EUR pagamento il 30 maggio 2011 62500; EUR 75.000 pagabile il 30 settembre 2011; EUR pagabile il 30 novembre 2011 75.000; EUR 75.000 pagabile il 28 febbraio 2012; EUR 75.000 pagabile il 30 maggio 2012. 14. Il giudice unico ha inoltre preso atto che il contratto di lavoro modificata del 23 febbraio 2009 a condizione che il giocatore sta per ricevere l'importo di "EUR 110,000 come una tassa per la firma del contratto, modifiche, entro 3 giorni dalla firma del presente". 15. In seguito, il giudice unico ha preso in considerazione il contenuto della presentazione finale del Richiedente inviato alla FIFA il 1 ° luglio 2011 e ha concluso che quest'ultima aveva basato il calcolo della sua richiesta finale di commissione sugli importi che il Resistente aveva guadagnato fino 4 gennaio 2011. In considerazione di ciò e sulla base del principio giuridico di non ultra petita, secondo la quale un organo decisionale non può andare al di là di ciò che viene richiesto, il giudice unico ha dichiarato che gli importi che devono essere presi in considerazione sono la retribuzione che avrebbe dovuto essere pagato dal club per il Resistente fino al 4 gennaio 2011 (cioè 2 x 20.000 euro più 4 x 56.250 euro più 2 x EUR 62.500 per un importo complessivo pari a 390 mila), nonché la tassa di firma (ie Euro 110.000) per un importo totale di 500.000 euro. 16. In conseguenza di tutto quanto sopra, il giudice unico ha concluso la sua analisi del caso di specie, decidendo che la domanda del ricorrente è parzialmente accolta, e che, di conseguenza, il convenuto deve versare alla richiedente un importo pari al 10% del totale lordo reddito di base in modo efficace a favore del convenuto in base al contratto di lavoro modificata del 23 febbraio 2009 ha concluso tra il Resistente e il club e che tale importo corrisponde a 50.000 euro (10% di 500.000 euro). 17. Infine, come la rivendicazione di interessi di mora, il giudice unico ha deciso che un interesse ad un tasso del 5% all'anno per l'importo di cui sopra dovrebbe essere concesso al richiedente e che tale interesse dovrebbe iniziare a correre a partire dalla data di la presente decisione, ossia il 18 luglio 2012. 18. Infine, il giudice unico di cui all'art. 25 par. 2 del Regolamento per lo Status ed il Trasferimento dei Calciatori in combinazione con l'art. 18 par. 1 del Regolamento di procedura, secondo cui, nel procedimento dinanzi alla commissione per lo Status dei Calciatori, tra cui il giudice unico, i costi per un importo massimo di CHF 25'000 di prelevamento. La disposizione precisa inoltre che i relativi costi sono a carico in considerazione del grado delle parti di successo nel procedimento. 19. In considerazione di quanto sopra e considerando che la domanda del ricorrente è stato parzialmente accolto, il giudice unico ha concluso che il Resistente deve sopportare tutte le spese del procedimento in corso dinanzi FIFA. Inoltre, e secondo all 'allegato A, del regolamento di procedura, le spese del procedimento devono essere prelevati sulla base del valore di causa. Su tale base, il giudice unico ha dichiarato che l'importo da prendere in considerazione nel presente procedimento è pari a 80.964. Di conseguenza, il giudice unico ha concluso che l'importo massimo delle spese del procedimento corrisponde a CHF 10'000. 20. In conclusione, e in considerazione delle circostanze della materia presente e se si considera che il caso in questione non ha posto particolari difficoltà di fatto o di complessità giuridica, il giudice unico determinato le spese del procedimento in corso alla quantità di CHF 7'000. Di conseguenza, il giudice unico della Commissione per lo Status dei Calciatori deciso che l'importo di CHF 7'000 deve essere pagato dal Resistente, al fine di coprire le spese del presente procedimento. III. Decisione del giudice unico di lo Status dei Calciatori Comitato 1. La richiesta del Richiedente, T, è parzialmente accolta. 2. Il Resistente, S, deve pagare all'attore, T, l'importo complessivo di 50.000 euro entro 30 giorni a partire dalla data di notifica della presente decisione, così come interessi del 5% annuo sull'importo detto a partire dal 18 lug 2012 fino alla data del pagamento effettivo. 3. Eventuali ulteriori richieste presentate dalla parte attrice, T, sono respinte. 4. In caso di mancato pagamento del suddetto importo, maggiorato degli interessi, entro il termine di cui sopra, la questione attuale deve essere presentata, su richiesta, alla commissione disciplinare della FIFA per l'esame e una decisione formale. 5. I costi finali dei lavori per un importo di CHF 7'000 sono a carico del convenuto, S, entro 30 giorni a partire dalla data di notifica della presente decisione come segue: 5.1 L'importo di CHF 5000 deve essere pagato alla FIFA al seguente conto bancario, con riferimento al nr caso:. Il Richiedente, T, è diretta ad informare il Resistente, S, immediatamente e direttamente il numero di conto sul quale l'rimessa ai punti 2 e 5.2 di cui sopra è da effettuare e di informare Commissione per lo Status dei Calciatori di ogni pagamento ricevuto. ** Nota relativa alla decisione motivata (ricorso giurisdizionale): Ai sensi dell'art. 67, par. 1 dello Statuto della FIFA, questa decisione può essere impugnata dinanzi al Tribunale Arbitrale dello Sport (TAS). CAS direttive________________________________________ F.I.F.A. - Players' Status Committee (2012-2013) – players’ and match agents disputes – official version by www.fifa.com - Decision of the Single Judge of the Players’ Status Committee passed in Zurich, Switzerland, on 18 July 2012, by Geoff Thompson (England) Single Judge of the Players’ Status Committee, on a claim presented by the Players’ agent T, as “Claimant” against the player S, as “Respondent” regarding a contractual dispute between the parties. I. Facts of the case 1. On 10 September 2008, the players’ agent T (hereinafter: the Claimant), licensed by the H Football Federation, and the player S (hereinafter: the Respondent) concluded a representation agreement (hereinafter: the agreement) valid from the date of signature until 10 September 2010. 2. Article 1 of the agreement stipulated that the Respondent assigned the Claimant “as his sole representative, delegate and consultant for country G and abroad and accounts him responsible for negotiating and administering on his behalf any kind of athletic action...”. Article 5 of the agreement further provided that “[T]he authorisation and command, which is provided to the Manager [i.e. the Claimant] is explicit and exclusive”. 3. Moreover, article 7 of the agreement provided that “[F]or the total service provided by the Manager [i.e. the Claimant], it is agreed that he is entitled with the amount of 10% of the Athlete’s [i.e. the Respondent] annual gross income, as a result of the contract of agreement which the Manager negotiated for amounts equal or above EUR 100,000”, whereas article 8 of the agreement stipulated that “The payment of the amount due to the Manager, either by contract or by subsidy rights, is to be processed in ten (10) days starting from the day Athletes receives a payment”. 4. On 2 March 2011, the Claimant lodged a claim in front of FIFA against the Respondent explaining that, on 23 February 2009, after lengthy negotiations the Claimant had allegedly carried out with the country G club P (hereinafter: the club P) on behalf of the Respondent, the employment contract dated 29 August 2007 entitled “Professional Player’s contract” between the club and the Respondent was amended and a new employment contract entitled “Agreement for the amendment of a professional players’ contract” dated 23 February 2009 was concluded and signed by the club, the Respondent and the Claimant. According to the Claimant, despite numerous attempts to contact the Respondent in order to receive his alleged agreed commission for his services, he had not received any amount. 5. Consequently, the Claimant requested from the Respondent the amount of EUR 74,909, representing, according to him, 10% of all gross payments received by the Respondent for the period from 23 February 2009 until 22 February 2011. The Claimant also requested the Respondent to pay an interest for late payment on the said amount at a rate of 5%. 6. On 1 July 2011, the Claimant amended his claim and explained that the Respondent had earned the following amounts since the employment contract with the club had been amended: A. Based on the above, the Claimant requested from the Respondent the sum of EUR 80,964, which corresponded to 10% of the Respondent’s gross income. 8. In spite of having been asked to do so, the Respondent never responded to the claim lodged against him, although he was informed that in absence of a response, a decision would be taken on the basis of the information and evidence at disposal. 9. On 14 June, the Claimant informed FIFA that he did not wish to submit any further comments in the matter at stake and requested the case to be submitted to the Players’ Status Committee for a formal decision. 10. The exact financial terms of the “Agreement for the amendment of a professional players’ contract” dated 23 February 2009 and provided by the Claimant are the following: “For the period from the signing of the present agreement until 30.06.2012 the player shall receive the total amount of EUR 815,000 in 14 instalments as follows”: EUR 20,000 payable on 28 February 2009; EUR 20,000 payable on 30 May 2009; EUR 56,250 payable on 30 September 2009; EUR 56,250 payable on 30 November 2009; EUR 56,250 payable on 28 February 2010; EUR 56,250 payable on 30 May 2010; EUR 62,500 payable on 30 September 2010; EUR 62,500 payable on 30 November 2010; EUR 62,500 payable on 28 February 2011; EUR 62,500 payable on 30 May 2011; EUR 75,000 payable on 30 September 2011; EUR 75,000 payable on 30 November 2011; EUR 75,000 payable on 28 February 2012; EUR 75,000 payable on 30 May 2012. “For the football season 2008-2009, if the player participates to the club’s official matches (country G Championship, Cup, UEFA Champions League) for more than 60% he will be entitled to receive the amount of EUR 50,000 as a bonus. Finally, the contract also provided that “The player will receive the amount of EUR 110,000 as a signing fee for the contract’s amendments, within 3 days by the signing of the present”. II. Considerations of the Single Judge of the Players’ Status Committee 1. First of all, the Single Judge of the Players’ Status Committee (hereinafter also referred to as: the Single Judge) analysed which procedural rules are applicable to the present matter. In this respect, the Single Judge referred to art. 21 par. 2 and 3 of the Rules governing the procedures of the Players’ Status Committee and the Dispute Resolution Chamber (edition 2008). The present matter was submitted to FIFA on 2 March 2011, thus after 1 July 2008. Therefore, the Singe Judge concluded that the current edition of the Procedural Rules (edition 2008; hereinafter: the Procedural Rules) is applicable to the matter in hand. 2. Subsequently, the Single Judge analysed which edition of the FIFA Players’ Agent Regulations should be applicable. In this respect, the Single Judge confirmed that in accordance with art. 39 par. 1 and 4 of the 2008 edition of the Players’ Agents Regulations, and considering that the present claim was lodged on 2 March 2011, the current edition of the Players’ Agents Regulations (edition 2008; hereinafter: the Regulations) is applicable to the matter at stake. 3. With regard to his competence, the Single Judge of the Players’ Status Committee pointed out that in accordance with art. 30 par. 2 of the Regulations, FIFA is competent to deal with international disputes in connection with the activities of players’ agents, i.e. natural persons who hold a valid players’ agent licence issued by the relevant member Associations. 4. The Single Judge continued his deliberations by indicating that the present matter concerns a dispute between a players’ agent licensed by the H Football Federation and a player, regarding an alleged outstanding commission. As a consequence, the Single Judge of the Players’ Status Committee is the competent body to decide on the present matter which has an international dimension. 5. His competence and the applicable regulations having been established, and entering into the substance of the present matter, the Singe Judge started by acknowledging the established facts of the case as well as the documents contained in the file. In this respect, the Single Judge noted that, on 10 September 2008, the Claimant and the Respondent had concluded an agreement according to which the latter had agreed to pay to the former a commission of 10% of his annual gross income in the event that the Claimant negotiated any contract on behalf of the Respondent for amounts “equal or above EUR 100,000”. 6. Equally, the Single Judge acknowledged that the player’s employment contract with the club was amended on 23 February 2009 and that the Claimant had signed said employment contract as the agent of the player and had therefore acted on his behalf. 7. Furthermore, the Single Judge acknowledged that, in his amended claim to FIFA, the Claimant had requested the payment of 10% of the Respondent’s annual gross income until 4 January 2011, arguing that the Respondent had not paid him the relevant commission according to the agreement. 8. In continuation, the Single Judge also remarked that the Respondent had not submitted any comments in response to the claim lodged against it by the Claimant. Consequently, the Single Judge deemed that, by acting in this way, the Respondent had renounced to his right of defence and it had therefore to be assumed that the Respondent had accepted the allegations of the Claimant. 9. Moreover, and taking into account that the club and the Respondent had amended their employment relationship on 23 February 2009 for a sum exceeding EUR 100,000, the Single Judge held that the conditions for the payment of the Claimant’s commission under the agreement had thus been met. 10. Bearing in mind the foregoing and in accordance with the basic legal principle of pacta sunt servanda, which in essence means that agreements must be respected by the parties in good faith, the Single Judge held that based on the agreement concluded between the parties, the Respondent had agreed to pay to remunerate the Claimant for his services. 11. In light of the above, the Single Judge reached the conclusion that the Claimant should be entitled to receive a remuneration of 10% of the basic gross payments received by the Respondent. 12. Having established the above, the Single Judge went on to calculate the exact amount to be paid by the Respondent to the Claimant as remuneration on the basis of the agreement. 13. In this regard, the Single Judge acknowledged the fact that the amendment of the employment contract concluded between the Respondent and the club on 23 February 2009 stipulated that the Respondent was supposed to receive, “for the period from signing of the present agreement until 30 June 2012”, the total amount of EUR 815,000 in 14 instalments as follows: EUR 20,000 payable on 28 February 2009; EUR 20,000 payable on 30 May 2009; EUR 56,250 payable on 30 September 2009; EUR 56,250 payable on 30 November 2009; EUR 56,250 payable on 28 February 2010; EUR 56,250 payable on 30 May 2010; EUR 62,500 payable on 30 September 2010; EUR 62,500 payable on 30 November 2010; EUR 62,500 payable on 28 February 2011; EUR 62,500 payable on 30 May 2011; EUR 75,000 payable on 30 September 2011; EUR 75,000 payable on 30 November 2011; EUR 75,000 payable on 28 February 2012; EUR 75,000 payable on 30 May 2012. 14. The Single Judge further took note that the amended employment contract dated 23 February 2009 provided that the player would receive the amount of “EUR 110,000 as a signing fee for the contract’s amendments, within 3 days by the signing of the present”. 15. In continuation, the Single Judge took into account the content of the last submission of the Claimant sent to FIFA on 1 July 2011 and concluded that the latter had based the calculation of his final request for commission on the amounts that the Respondent had earned up until 4 January 2011. In view of this and on the basis of the legal principle of non ultra petita, according to which a decision-making body cannot go beyond what is requested, the Single Judge held that the amounts which have to be taken into consideration are the remuneration which should have been paid by the club to the Respondent until 4 January 2011 (i.e. 2 x EUR 20,000 plus 4 x EUR 56,250 plus 2 x EUR 62,500 for a total amounting to EUR 390,000) as well as the signing fee (i.e. EUR 110,000) for a total amount of EUR 500,000. 16. As a consequence of all of the above, the Single Judge concluded his analysis of the present case by deciding that the Claimant’s claim is partially accepted, and that, therefore, the Respondent must pay to the Claimant an amount equal to 10% of the total gross basic income effectively payable to the Respondent according to the amended employment contract dated 23 February 2009 concluded between the Respondent and the club and that such amount corresponds to EUR 50,000 (i.e. 10% of EUR 500,000). 17. Finally, and as to claim for interest for late payment, the Single Judge decided that an interest at a rate of 5% per year over the aforementioned amount should also be granted to the Claimant and that such interest should start running as from the date of the present decision, i.e. 18 July 2012. 18. Lastly, the Single Judge referred to art. 25 par. 2 of the Regulations for the Status and Transfer of Players in combination with art. 18 par. 1 of the Procedural Rules, according to which, in the proceedings before the Players’ Status Committee, including the Single Judge, costs in the maximum amount of CHF 25,000 are levied. The relevant provision further states that the costs are to be borne in consideration of the parties’ degree of success in the proceedings. 19. On account of the above and considering that the claim of the Claimant has been partially accepted, the Single Judge concluded that the Respondent has to bear the entire costs of the current proceedings before FIFA. Furthermore and according to Annexe A of the Procedural Rules, the costs of the proceedings are to be levied on the basis of the amount in dispute. On that basis, the Single Judge held that the amount to be taken into consideration in the present proceedings is EUR 80,964. Consequently, the Single Judge concluded that the maximum amount of costs of the proceedings corresponds to CHF 10,000. 20. In conclusion, and in view of the circumstances of the present matter and considering that the case at hand did not pose any particular factual difficulty or legal complexity, the Single Judge determined the costs of the current proceedings to the amount of CHF 7,000. Consequently, the Single Judge of the Players’ Status Committee decided that the amount of CHF 7,000 has to be paid by the Respondent in order to cover the costs of the present proceedings. III. Decision of the Single Judge of the Players’ Status Committee 1. The claim of the Claimant, T, is partially accepted. 2. The Respondent, S, has to pay to the Claimant, T, the total amount of EUR 50,000 within 30 days as from the date of notification of this decision, as well as 5% interest per year on the said amount as from 18 July 2012 until the date of effective payment. 3. Any further claims lodged by the Claimant, T, are rejected. 4. In case of non-payment of the abovementioned amount, plus interest, within the aforementioned deadline, the present matter shall be submitted, upon request, to FIFA’s Disciplinary Committee for consideration and a formal decision. 5. The final costs of the proceedings in the amount of CHF 7,000 are to be paid by the Respondent, S, within 30 days as from the date of notification of the present decision as follows: 5.1 The amount of CHF 5,000 has to be paid to FIFA to the following bank account with reference to case nr.: UBS Zurich Account number 366.677.01U (FIFA Players’ Status) Clearing number 230 IBAN: CH27 0023 0230 3666 7701U SWIFT: UBSWCHZH80A 5.2 The amount of CHF 2,000 has to be paid to the Claimant, T. 6. The Claimant, T, is directed to inform the Respondent, S, immediately and directly of the account number to which the remittance under points 2 and 5.2 above is to be made and to notify the Players’ Status Committee of every payment received. ** Note relating to the motivated decision (legal remedy): According to art. 67 par. 1 of the FIFA Statutes, this decision may be appealed against before the Court of Arbitration for Sport (CAS). The statement of appeal must be sent to the CAS directly within 21 days of receipt of notification of this decision and shall contain all the elements in accordance with point 2 of the directives issued by the CAS, a copy of which we enclose hereto. Within another 10 days following the expiry of the time limit for filing the statement of appeal, the appellant shall file a brief stating the facts and legal arguments giving rise to the appeal with the CAS (cf. point 4 of the directives).
