I. Fatti della causa. / ... 1. Il 28 maggio 2009, l’ allenatore X del paese S (di seguito "il richiedente") ed il Club Z del paese C (in prosieguo: "il convenuto") hanno sottoscritto un contratto di lavoro (in prosieguo: "il contratto") valido dal 1 giugno 2009 al 31 maggio 2010. 2. L'articolo 3 del contratto stipulato che l'attore avrebbe ricevuto dal convenuto un importo complessivo di euro 35.200, come gli stipendi, pagabili in "11 (undici) rate mensili di Euro 3200", la prima causa il 1 ° agosto 2009 e l'ultimo il 31 maggio 2010. 3. L'8 giugno 2011 la ricorrente ha presentato una denuncia davanti FIFA contro il convenuto affermando che quest'ultima non aveva effettuato il pagamento di due mensilità corrispondenti alle rate di aprile 2010 e maggio 2010 per un importo totale di euro 6.400. 4. A questo proposito, il ricorrente ha sostenuto che dopo che il convenuto non era riuscito a pagare lo stipendio del mese di aprile 2010, lo aveva informato che sarebbe stata pagata con lo stipendio di maggio 2010 scadenza il 31 maggio 2010. La ricorrente ha inoltre sostenuto che la convenuta aveva alla fine non è riuscito a pagare qualsiasi dei due presunti stipendi in sospeso. 5. Nonostante essendo prevista una possibilità di farlo dalla FIFA, il convenuto non ha presentato alcuna dichiarazione, anche se è stato informato che, in assenza di risposta, la decisione sarebbe stata presa sulla base delle informazioni e delle prove a disposizione. II. Considerazioni del giudice unico di lo Status dei Calciatori Comitato 1. Prima di tutto, il giudice unico del Comitato per lo Status dei Calciatori (di seguito: "il giudice unico") ha analizzato se era competente a trattare il caso a portata di mano. A questo proposito, il giudice unico confermato che, sulla base di arte. 3 par. 1 della edizione 2008 le norme che disciplinano le procedure della Commissione per lo Status del Calciatore e della Camera di risoluzione delle controversie in relazione con l'arte. 23 par. 1 e 3, nonché art. 22 lit. c) l'edizione 2010 del Regolamento sullo status e sul trasferimento dei calciatori, era competente a trattare la questione in gioco, che riguarda un occupazionale controversia con una dimensione internazionale tra un allenatore e un club affiliato alla Football Association C . 2. Inoltre, il giudice unico ha analizzato quali sono le norme procedurali applicabili alla questione a portata di mano. A questo proposito, ha fatto riferimento all'art. 21 par. 2 e 3 della edizione 2008 delle norme che regolano le procedure della Commissione per lo Status del Calciatore e della Camera di Risoluzione delle Controversie. Di conseguenza, e poiché la questione attuale è stato presentato alla FIFA, l'8 giugno 2011, il giudice unico ha concluso che l'attuale edizione delle norme che regolano le procedure del Comitato per lo Status del Calciatore e della Camera di Risoluzione delle Controversie (edizione 2008, in prosieguo: "la procedura Regolamento ") è applicabile in materia a portata di mano. 3. Successivamente, il giudice unico ha analizzato l'edizione del Regolamento sullo status e sul trasferimento dei calciatori dovrebbero essere applicabili a conoscere del merito della questione. A questo proposito, si è riferito, da un lato, dell'art. 26 par. 1 e 2 della edizione 2010 del Regolamento sullo status e sul trasferimento dei calciatori, e, dall'altro, al fatto che la presente domanda è stata presentata davanti alla FIFA l'8 giugno 2011. In considerazione di quanto precede, il giudice unico ha concluso che l'attuale edizione del Regolamento sullo status e sul trasferimento dei calciatori (in prosieguo: "lo statuto") è applicabile al caso in esame nel merito. 4. La sua competenza e le norme vigenti che sono stati istituiti, il giudice unico è entrato nel merito della questione. In questo modo e prima di tutto, il giudice unico ha osservato che il convenuto non aveva presentato la sua posizione per il ricorso presentato contro di essa da parte del richiedente, pur essendo stato invitato a farlo dalla FIFA. Pertanto, il giudice unico ha concluso che, in questo modo, la convenuta aveva rinunciato al suo diritto di difesa e, quindi, si doveva presumere di aver accettato le affermazioni del ricorrente. 5. Di conseguenza, il giudice unico di cui all'art. 9 par. 3 delle norme procedurali e ha sottolineato che in materia presente decisione è adottata sulla base dei documenti in archivio, in altre parole, al momento le accuse ei documenti presentati dal richiedente. 6. A questo proposito, il giudice unico ha preso atto che in data 28 maggio 2009, l'attore e il convenuto ha concluso un contratto di lavoro valido per un anno, vale a dire dal 1 ° giugno 2009 al 31 maggio 2010. 7. In particolare, il giudice unico ha preso atto che è stato contrattualmente pattuito (cfr. articolo tre del contratto di lavoro), che il ricorrente avrebbe ricevuto dal convenuto un importo complessivo di euro 35.200, come gli stipendi e che tale importo sarebbe stato versato dal convenuto nella 11 rate mensili uguali di euro 3.200 ciascuna, a partire dal 1 ° agosto 2009 e termina il 31 maggio 2010. 8. In seguito, il giudice unico ha sottolineato che, durante l'istruttoria della pratica in questione, il ricorrente sostiene che la convenuta ha omesso di pagare lui le ultime due rate mensili che erano in origine entro il 30 aprile 2010 e 31 maggio 2010, per un importo totale di euro 6.400. 9. A questo proposito, il giudice unico ha preso atto che il richiedente ha dichiarato che il convenuto aveva apparentemente promesso di pagare le rate mensili di cui sopra in data 31 maggio 2010, ma, alla fine, non era riuscito a farlo. 10. In tale contesto, il giudice unico che si ritiene opportuno ribadire che, nel corso dell'istruttoria della questione in gioco, la resistente non ha contestato alcuna delle accuse o delle prove documentali fornite dal richiedente. 11. Alla luce di tutte le considerazioni sopra esposte, il giudice unico ha deciso che la domanda del ricorrente è pienamente accettato e che il convenuto deve versare al ricorrente l'importo di euro 6.400. 12. Infine, il giudice unico di cui all'art. 25 par. 2 del Regolamento in combinazione con l'art. 18 par. 1 del Regolamento di procedura, secondo cui, nel procedimento dinanzi alla commissione per lo Status dei Calciatori, tra cui il giudice unico, i costi per un importo massimo di CHF 25'000 di prelevamento. La disposizione precisa inoltre che i relativi costi sono a carico in considerazione del grado delle parti di successo nel procedimento. 13. Inoltre, e secondo all 'allegato A, del regolamento di procedura, le spese del procedimento devono essere prelevati sulla base del valore di causa. Il valore della controversia da prendere in considerazione nel presente procedimento è pari a 6.200. Di conseguenza, il giudice unico ha concluso che l'importo massimo delle spese del procedimento corrisponde a CHF 5000. 14. Considerando che, nel caso di specie, la responsabilità del mancato rispetto del contratto di lavoro può essere interamente attribuito al convenuto e tenendo conto delle circostanze particolari della materia presente, il giudice unico determinato i costi del procedimento in corso in l'importo di 5000 franchi e ha dichiarato che tali costi devono essere a carico del convenuto. 15. In conclusione, l'importo di 5.000 franchi svizzeri deve essere pagato da parte del convenuto, al fine di coprire le spese del presente procedimento. III. Decisione del giudice unico di lo Status dei Calciatori Comitato 1. La richiesta del Richiedente, X, è accettato. 2. Il Resistente, Club Z, deve pagare all'attore, X, la somma di EUR 6400 in ordine alle retribuzioni in essere, entro 30 giorni a partire dalla data di notifica della presente decisione. 3. Se la somma di cui sopra non è pagata entro il termine di cui sopra, un tasso d'interesse del 5% annuo si applica a decorrere dalla scadenza del termine fissato e la questione attuale sono presentati, su richiesta, alla commissione disciplinare della FIFA per l'esame e un formale decisione. 4. L'importo finale delle spese del procedimento pari a CHF 5000 sono a carico del convenuto, Club Z, entro 30 giorni a partire dalla data di notifica della presente decisione, come segue: 4.1 CHF 4'000, alla FIFA alla banca seguente conto con riferimento al procedimento n. UBS Zurigo Numero di conto 366.677.01U (Stato Calciatori) Clearing numero 230 IBAN: CH27 0023 0230 3666 7701 U SWIFT: UBSWCHZH80A 4.2 CHF 1000, all'attore, X. 5. Il Richiedente, X, è diretta ad informare il Resistente, Club Z, immediatamente e direttamente il numero di conto a cui la rimessa di cui ai punti 2 e 4.2 di cui sopra è da effettuare e di informare Commissione per lo Status dei Calciatori di ogni pagamento ricevuto. ** Nota relativa alla decisione motivata (ricorso giurisdizionale): Ai sensi dell'art. 67, par. 1 dello Statuto della FIFA, questa decisione può essere impugnata dinanzi al Tribunale Arbitrale dello Sport (TAS). La dichiarazione di ricorso deve essere inviato al CAS direttamente entro 21 giorni dal ricevimento della notifica della presente decisione e deve contenere tutti gli elementi di cui al punto 2 delle direttive impartite dal CAS, una copia della quale si allega alla presente. CAS direttive________________________________________ F.I.F.A. - Players' Status Committee (2012-2013) – coach disputes – official version by www.fifa.com - Decision of the Single Judge of the Players’ Status Committee passed in Zurich, Switzerland, on 15 August 2012, by Geoff Thompson (England) Single Judge of the Players’ Status Committee, on the claim presented by the coach X, as “Claimant” against the club Z, as “Respondent” regarding a contractual dispute between the parties. I. Facts of the case ./… 1. On 28 May 2009, the country S coach X (hereinafter: “the claimant”) and the country C club Z (hereinafter: “the respondent”) signed an employment contract (hereinafter: “the contract”) valid from 1 June 2009 until 31 May 2010. 2. Article 3 of the contract stipulated that the claimant would receive from the respondent a total amount of EUR 35,200 as salaries, payable in “11 (eleven) monthly instalments of EUR 3,200”, the first one due on 1 August 2009 and the last one on 31 May 2010. 3. On 8 June 2011, the claimant lodged a complaint in front of FIFA against the respondent stating that the latter had not made payment of two monthly salaries corresponding to the instalments of April 2010 and May 2010 for a total amount of EUR 6,400. 4. In this respect, the claimant alleged that after the respondent had failed to pay him his salary of April 2010, it had informed him that it would be paid together with the salary of May 2010 due on 31 May 2010. The claimant further alleged that the respondent had eventually failed to pay any of the two alleged outstanding salaries. 5. In spite of being provided an opportunity to do so by FIFA, the respondent did not submit any statement, although it was informed that, in absence of a reply, a decision would be taken on the basis of the information and evidence at disposal. II. Considerations of the Single Judge of the Players´ Status Committee 1. First of all, the Single Judge of the Players´ Status Committee (hereinafter: “the Single Judge”) analysed whether he was competent to deal with the case at hand. In this respect, the Single Judge confirmed that, on the basis of art. 3 par. 1 of the 2008 edition the Rules governing the procedures of the Players’ Status Committee and the Dispute Resolution Chamber in connection with art. 23 par. 1 and 3 as well as art. 22 lit. c) of the 2010 edition of the Regulations on the Status and Transfer of Players, he was competent to deal with the matter at stake which concerns an employment-related dispute with an international dimension between a coach and a club affiliated to the Football Association C. 2. Furthermore, the Single Judge analysed which Procedural Rules are applicable to the matter at hand. In this respect, he referred to art. 21 par. 2 and 3 of the 2008 edition of the Rules governing the procedures of the Players’ Status Committee and the Dispute Resolution Chamber. Consequently, and since the present matter was submitted to FIFA on 8 June 2011, the Single Judge concluded that the current edition of the Rules governing the procedures of the Players’ Status Committee and the Dispute Resolution Chamber (edition 2008; hereinafter: “the Procedural Rules”) is applicable to the matter at hand. 3. Subsequently, the Single Judge analysed which edition of the Regulations on the Status and Transfer of Players should be applicable as to the substance of the matter. In this respect, he referred, on the one hand, to art. 26 par. 1 and 2 of the 2010 edition of the Regulations on the Status and Transfer of Players, and on the other hand, to the fact that the present claim was lodged in front of FIFA on 8 June 2011. In view of the foregoing, the Single Judge concluded that the current edition of the Regulations on the Status and Transfer of Players (hereinafter: “the Regulations”) is applicable to the case at hand as to the substance. 4. His competence and the applicable regulations having been established, the Single Judge entered into the substance of the matter. In doing so and first of all, the Single Judge observed that the respondent had never submitted its position to the claim lodged against it by the claimant, despite having been asked to do so by FIFA. Therefore the Single Judge concluded that, in this way, the respondent had renounced to its right of defence and, thus, it had to be assumed that it had accepted the allegations of the claimant. 5. As a consequence, the Single Judge referred to art. 9 par. 3 of the Procedural Rules and pointed out that in the present matter a decision shall be taken upon the basis of the documents on file, in other words upon the allegations and documents submitted by the claimant. 6. In this respect, the Single Judge took note that on 28 May 2009, the claimant and the respondent concluded an employment contract valid for one year, i.e. as of 1 June 2009 until 31 May 2010. 7. In particular, the Single Judge took note that it was contractually agreed (cf. article three of the employment contract) that the claimant would receive from the respondent a total amount of EUR 35,200 as salaries and that this amount would be paid by the respondent in 11 equal monthly instalments of EUR 3,200 each one, starting on 1 August 2009 and finishing on 31 May 2010. 8. In continuation, the Single Judge pointed out that, during the investigation of the matter at stake, the claimant alleged that the respondent had failed to pay him the last two monthly instalments which were originally due on 30 April 2010 and 31 May 2010, for a total amount of EUR 6,400. 9. In this respect, the Single Judge took note that the claimant stated that the respondent had apparently promised him to pay the aforementioned monthly instalments on 31 May 2010 but, eventually, had failed to do so. 10. In this context, the Single Judge deemed appropriate to reiterate that, during the investigation of the matter at stake, the respondent did not contest any of the allegations or documentary evidence provided by the claimant. 11. In view of all the above-mentioned considerations, the Single Judge decided that the claim of the claimant is fully accepted and that the respondent has to pay to the claimant the amount of EUR 6,400. 12. Finally, the Single Judge referred to art. 25 par. 2 of the Regulations in combination with art. 18 par. 1 of the Procedural Rules, according to which, in the proceedings before the Players’ Status Committee, including the Single Judge, costs in the maximum amount of CHF 25,000 are levied. The relevant provision further states that the costs are to be borne in consideration of the parties’ degree of success in the proceedings. 13. Furthermore and according to Annexe A of the Procedural Rules, the costs of the proceedings are to be levied on the basis of the amount in dispute. The amount in dispute to be taken into consideration in the present proceedings is EUR 6,200. Consequently, the Single Judge concluded that the maximum amount of costs of the proceedings corresponds to CHF 5,000. 14. Considering that, in the case at hand, the responsibility of the failure to comply with the employment contract can entirely be attributed to the respondent and taking into account the particular circumstances of the present matter, the Single Judge determined the costs of the current proceedings in the amount of CHF 5,000 and held that such costs have to be borne by the respondent. 15. In conclusion, the amount of CHF 5,000 has to be paid by the respondent in order to cover the costs of the present proceedings. III. Decision of the Single Judge of the Players´ Status Committee 1. The claim of the Claimant, X, is accepted. 2. The Respondent, Club Z, has to pay to the Claimant, X, the amount of EUR 6,400 as outstanding salaries, within 30 days as from the date of notification of this decision. 3. If the aforementioned sum is not paid within the aforementioned deadline, an interest rate of 5% per year will apply as of expiry of the fixed time limit and the present matter shall be submitted, upon request, to FIFA’s Disciplinary Committee for consideration and a formal decision. 4. The final amount of costs of the proceeding amounting to CHF 5,000 are to be paid by the Respondent, Club Z, within 30 days as from the date of notification of the present decision, as follows: 4.1 CHF 4,000, to FIFA to the following bank account with reference to case no.: UBS Zurich Account number 366.677.01U (FIFA Players’ Status) Clearing number 230 IBAN: CH27 0023 0230 3666 7701U SWIFT: UBSWCHZH80A 4.2 CHF 1,000, to the Claimant, X. 5. The Claimant, X, is directed to inform the Respondent, Club Z, immediately and directly of the account number to which the remittance under points 2 and 4.2 above is to be made and to notify the Players’ Status Committee of every payment received. ** Note relating to the motivated decision (legal remedy): According to art. 67 par. 1 of the FIFA Statutes, this decision may be appealed against before the Court of Arbitration for Sport (CAS). The statement of appeal must be sent to the CAS directly within 21 days of receipt of notification of this decision and shall contain all the elements in accordance with point 2 of the directives issued by the CAS, a copy of which we enclose hereto. Within another 10 days following the expiry of the time limit for filing the statement of appeal, the appellant shall file a brief stating the facts and legal arguments giving rise to the appeal with the CAS (cf. point 4 of the directives).
