F.I.F.A. - Camera di Risoluzione delle Controversie (2004-2005) - indennità di formazione - versione non ufficiale by dirittocalcistico - Decisione della Camera di Risoluzione delle Controversie a Zurigo, in Svizzera, il 9 novembre 2004, nella seguente composizione: Slim Aloulou (Tunisia), Presidente Philippe Piat (Francia), membro Philippe Diallo (Francia), membro del reclamo presentato dal club, X, Giappone, come querelanti nei confronti del club, Y, Paesi Bassi, come convenuto quanto riguarda l'indennità di formazione in connessione con il giocatore, Z , Fatti all'origine della controversia - Il giocatore, Z, nato il 25 febbraio 1981, è stato contrattualmente vincolato a X decorrere dal 1o giugno 2000 e fino al 1o gennaio 2001. - Secondo il club giapponese, il giocatore entrato X direttamente da università senza aver praticato non dilettanti di calcio con qualsiasi altro club. - Un altro contratto di lavoro è stato firmato tra le parti validi dal 1o febbraio 2001 fino al 1o gennaio 2002 e un terzo contratto è stato firmato per il periodo dal 1o febbraio 2002 fino al 1 ° gennaio 2003. - Il club ricorda che il giocatore è stato selezionato per le partite della squadra nazionale e ha presentato copie di richieste per il rilascio del giocatore. - X sostiene che il 26 novembre 2002 ha avanzato una proposta al giocatore per prolungare il contratto di lavoro. - Nel gennaio 2003, il club giapponese imparato a conoscere la richiesta di un certificato internazionale di trasferimento di tesseramento (IRTC) fatta dalla Federcalcio olandese per il giocatore in questione a favore di Y. - Il Giappone Football Association ha rilasciato la IRTC il 20 gennaio 2003. - Il club giapponese sostiene di aver sostenuto i seguenti costi durante le attività del giocatore al club: Yen 185.165.132 relativi agli stipendi e Yen 22,950,526 per quanto riguarda le altre spese. - X sostiene che il diritto di ricevere l'indennità di formazione da Y per l'intero periodo che è stato registrato Z al club giapponese, vale a dire dal 1 ° giugno 2000 e fino al 1 ° gennaio 2003 e chiede che la RDC determina l'importo dovuto. Essa sostiene, inoltre, il pagamento di interessi a decorrere dalla data in cui l'indennità di formazione avrebbe dovuto essere pagato dal club olandese, nonché delle spese legali. - A questo proposito, il club giapponese fa riferimento all'articolo 16 del Regolamento per lo Status ed il Trasferimento dei Calciatori, nonché dell'articolo 5 del Regolamento che disciplinano l'applicazione dei regolamenti sopra citati e alla lettera circolare 826, secondo cui l'importo indicativo di 90.000 euro a stagione la formazione (categoria 1 club in Europa) si applicherebbe. - Y, da parte sua, sostiene che non devo alcuna indennità di formazione al club giapponese, come il giocatore chiaramente aveva terminato la sua formazione prima ha raggiunto l'età di 21 anni. A questo proposito, il club olandese sottolinea che il giocatore è stato selezionato per la nazionale coreana durante la Coppa del Mondo 2002. Secondo Y, il periodo di formazione del giocatore termina quando ha firmato un contratto con il club giapponese. - Secondo il club Japanese, l'argomento Y non è valido, poiché, secondo al risarcimento dichiarazione del genere non sarebbe dovuta per quasi tutti i giocatori oltre 18 anni, come molti di questi giocatori di partecipare a squadre serie A e fanno parte di sezioni delle squadre nazionali . Inoltre, X sottolinea che tale argomento non tiene conto del fatto che il livello dei requisiti, lo sviluppo e la competenza del calcio europeo è superiore a quello del calcio asiatico. - Secondo il Giappone Football Association (cf. fax datato 1 luglio 2004), X è una due club di categoria. Considerazioni della Camera di Risoluzione delle Controversie I membri della Camera di Risoluzione delle Controversie sono stati convocati per passare una decisione su tale questione dal presidente ai sensi dell'art. 1 punto 6) del Regolamento prassi e procedure della Camera di Risoluzione delle Controversie. Come stabilito dall'art. 42 § 1 (b) (iv) del Regolamento FIFA sullo status e sul trasferimento dei giocatori, rientra nella competenza della Camera di Risoluzione delle Controversie di decidere sulle controversie relative al risarcimento per la formazione e l'istruzione dei giovani calciatori e di adeguare la formazione tasse di compensazione. Nel caso in esame, la Z giocatore è stato trasferito a Y, all'età di 21 anni. Come risultato, si pone la questione se X è autorizzato a chiedere l'indennità di formazione, come previsto dall'art. 13 e seguenti del regolamento di trasferimento della FIFA. Indennità di formazione è a carico del nuovo club con il quale un giocatore ha firmato un contratto di formazione e istruzione che ha ricevuto a partire dall'età di 12 fino a 21, da pagare fino a quando non raggiunge l'età di 23. Il giocatore, Z, è stato occupato da X a 19 anni e rimase con il club giapponese durante 2,5 stagioni sportive. Y respinge il reclamo presentato dal club giapponese, sostenendo che nel momento in cui Z è stato trasferito al club olandese, aveva già terminato la sua formazione, che presumibilmente è avvalorata dal fatto che Z è stato selezionato per la sua squadra nazionale nel corso del 2002 Coppa del Mondo. Y afferma che la formazione del giocatore era già finito quando ha firmato un contratto con X. A questo proposito, i membri della Camera sono del parere che il fatto che il giocatore è stato selezionato per la sua squadra nazionale per i Mondiali del 2002, quando già aveva compiuto 21 anni, dimostra che egli è stato debitamente istruito dal club giapponese. Inoltre, la Camera ha tenuto conto del fatto che Y non ha fornito alcuna prova documentale a sostegno delle sue affermazioni. In questo contesto, la Camera ha sottolineato che la parte che sostiene che un giocatore finito la sua formazione prima del suo 21esimo compleanno trasmettono alla Camera di Risoluzione delle controversie con la prova richiesta scritta. A questo proposito, la Camera ha preso atto del fax che è stato ricevuto dall'amministrazione FIFA dagli olandesi Federcalcio l'8 novembre 2004 osservazioni supplementari di trasporto per conto del suo membro del club Y. Il club olandese critica il fatto che solo il Venerdì 5 novembre Il 2004 è stato il club informato del fatto che la questione attuale è stato iscritto all'ordine del giorno della riunione della Camera di Risoluzione delle Controversie, il 9 e il 10 novembre 2004. A questo proposito, con riferimento all'articolo 16.3 (c) del Regolamento FIFA sullo status e sul trasferimento dei giocatori Y afferma che essa non poteva che preparare la propria difesa il Lunedi 8 novembre 2004. Dopo un attento studio del fascicolo, i membri della Camera ha concluso che i procedimenti amministrativi sono state debitamente finalizzato prima della comunicazione della data della riunione della Camera di Risoluzione delle Controversie alle parti coinvolte nella controversia. In realtà, il club olandese è stata data ampia possibilità di presentare la sua risposta. L'11 maggio 2004 il club olandese è stato invitato a presentare la sua risposta al ricorso presentato dal club giapponese, il 26 maggio 2004, quale termine è stato ignorato. Pertanto, a mezzo fax datato 4 giugno 2004, il club olandese è stato dato un secondo termine con scadenza 11 giugno 2004 per presentare la sua risposta, che è pervenuta il 9 giugno 2004. Il 11 giugno 2004, il procedimento amministrativo essendo venuto alla fine, le parti sono state informate che la questione sarebbe stata sottoposta alla Camera di risoluzione delle controversie per una decisione formale, la data di riunione di cui sarebbe stato comunicato in una fase successiva. Pertanto, i membri della Camera hanno convenuto che le osservazioni del club olandese che sono stati trasmessi dagli olandesi Federcalcio l'8 novembre 2004 deve essere considerato inappropriato. Alla luce di quanto sopra, la Camera ha deciso che Y deve pagare un'indennità di formazione ad X per il giocatore in questione in conformità ai suddetti regolamenti e circolari lettera n. 826 del 31 ottobre 2002. Prendendo in considerazione quanto sopra, si può stabilire che il giocatore, Z, è stato formato e sviluppato dal X del club giapponesi di età compresa tra 19 e 21. Ai sensi dell'articolo 5.1 del Regolamento d'Applicazione del Regolamento sullo status e sul trasferimento dei giocatori, "ai fini del calcolo compensaton, il periodo di formazione ... termine alla fine della stagione o della sua (del giocatore) 21 ° compleanno. "Inoltre, l'importo dovuto dagli olandesi del club Y deve essere calcolato in base ai parametri forniti dalla circolare 826 del 31 ottobre 2002, cioè con un importo pari a EUR 60.000 per ogni anno di formazione tra le età di 19 su 21 ( corrispondente alla categoria di club 2 X). A questo proposito, la Camera notato che X ha erroneamente basato il suo calcolo sulla categoria club Y . Cioè, ai sensi dell'articolo 7.3 del Regolamento di applicazione e detta lettera circolare, il calcolo si basa sui costi del paese in che il nuovo club si trova. Pertanto, X essendo un club di 2a categoria, l'importo della indennità di formazione si ottiene moltiplicando l'importo corrispondente alla categoria del club formazione per la quale è stato registrato il giocatore per il numero di anni di formazione 12-21 (cfr. art. 7.1 del Regolamento di applicazione), sulla base dei costi dei club di 2a categoria nei Paesi Bassi. Di conseguenza, X ha diritto a ricevere l'indennità di formazione per l'importo totale di 120.000 euro (2 stagioni x 60 mila euro). La Camera ha deciso di respingere le conclusioni X per il pagamento degli interessi e il rimborso delle spese legali. i f decisione del Camera di Risoluzione delle Controversie 1. La pretesa del ricorrente, X, è parzialmente accolta. 2. Il Resistente, Y, è tenuto a pagare l'importo di 120.000 euro al Richiedente. 3. L'importo dovuto per l'attore deve essere pagato dal convenuto entro 30 giorni dalla data di notifica della presente decisione. 4. Se la somma di 120.000 euro non viene pagata entro il termine suddetto, la presente questione deve essere presentata al Comitato Disciplinare della FIFA, in modo che le necessarie sanzioni disciplinari possono essere imposte. 5. Ai sensi dell'art. 60 par. 1 dello Statuto della FIFA, questa decisione può essere impugnata dinanzi alla Corte di Arbitrato per lo Sport (CAS). La dichiarazione di ricorso deve essere inviato direttamente al CAS entro 10 giorni dal ricevimento della notifica della presente decisione e deve contenere tutti gli elementi in conformità del punto 2 delle direttive impartite dal CAS, di cui una copia si allega alla presente. Entro altri 10 giorni successivi alla scadenza del termine per la presentazione della dichiarazione di ricorso, la ricorrente deve presentare una breve indicazione dei fatti e argomenti giuridici che danno luogo al ricorso con il CAS (cfr. punto 4 delle direttive). It furthermore claims payment of interest as from the date on which the training compensation should have been paid by the Dutch club as well as of legal fees. − In this respect, the Japanese club refers to article 16 of the Regulations for the Status and Transfer of Players as well as to article 5 of the Regulations governing the Application of the aforementioned Regulations and to circular letter 826, according to which the indicative amount of EUR 90,000 per training season (category 1 club in Europe) would apply. − Y, for its part, maintains that it does not owe any training compensation to the Japanese club as the player clearly had terminated his training before he reached the age of 21. In this respect, the Dutch club points out that the player was selected for the national Korean team during the 2002 World Cup. According to Y, the training period of the player terminated when he signed a contract with the Japanese club. − According to the Japanese club, Y’s argument is not valid, since according to such statement compensation would not be payable for almost any player over 18 years old as many of these players participate in first division teams and form part of sections of the national teams. Furthermore, X stresses that such argument fails to take into account that the level of requirements, development and competence of European football is higher than that of Asiatic football. − According to the Japan Football Association (cf. fax dated 1 July 2004), X is a category 2 club. Considerations of the Dispute Resolution Chamber The members of the Dispute Resolution Chamber were summoned to pass a decision on this matter by the Chairman pursuant to Art. 1 point 6) of the Rules Governing the Practice and Procedures of the Dispute Resolution Chamber. As established in art. 42 §1 (b) (iv) of the FIFA Regulations for the Status and Transfer of Players, it falls within the purview of the Dispute Resolution Chamber to decide on disputes concerning the compensation for the training and education of young players and to adjust training compensation fees. In the case at hand, the player Z was transferred to Y at the age of 21. As a result, the question arises whether X is entitled to claim training compensation as provided for in Art. 13 and following of the FIFA transfer regulations. Training compensation is payable by the new club with which a player has signed a contract for training and education that he received from the age of 12 up to 21, payable until he reaches the age of 23. The player, Z, was employed by X at the age of 19 and remained with the Japanese club during 2,5 sportive seasons. Y rejects the claim put forward by the Japanese club, maintaining that at the time that Z was transferred to the Dutch club, he had already terminated his training, which allegedly is corroborated by the fact that Z was selected for his national team during the 2002 World Cup. Y asserts that the player’s training had already finished when he signed on with X. In this respect, the members of the Chamber were of the opinion that the fact that the player was selected for his national team for the 2002 World Cup, when he already had turned 21, shows that he was duly trained by the Japanese club. Furthermore, the Chamber took into account that Y has failed to provide any documentary evidence in support of its assertions. In this context, the Chamber pointed out that the party claiming that a player finished his training prior to his 21st birthday shall provide the Dispute Resolution Chamber with the required written evidence. In this regard, the Chamber took note of the fax which was received by the FIFA administration from the Dutch Football Federation on 8 November 2004 conveying supplementary remarks on behalf of its member club Y. The Dutch club criticizes the fact that only on Friday 5 November 2004 was the club informed of the fact that the present matter was included in the agenda for the meeting of the Dispute Resolution Chamber on 9 and 10 November 2004. In this regard, with reference to article 16.3(c) of the FIFA Regulations for the Status and Transfer of Players Y asserts that it could only prepare its defence on Monday 8 November 2004. After careful study of the relevant file, the members of the Chamber concluded that the administrative proceedings were duly finalised prior to the communication of the date of the meeting of the Dispute Resolution Chamber to the parties involved in the dispute. In fact, the Dutch club has been given ample opportunity to present its response. On 11 May 2004 the Dutch club was invited to present its reply to the claim lodged by the Japanese club on 26 May 2004, which deadline was ignored. Therefore, by fax dated 4 June 2004, the Dutch club was given a second deadline expiring on 11 June 2004 to present its reply, which was received on 9 June 2004. On 11 June 2004, the administrative proceedings having come to an end, the parties were informed that the matter would be submitted to the Dispute Resolution Chamber for a formal decision, the meeting date of which would be communicated at a later stage. Therefore, the members of the Chamber agreed that the comments of the Dutch club which have been conveyed by the Dutch Football Federation on 8 November 2004 must be considered inappropriate. In the light of the above, the Chamber decided that Y must pay training compensation to X for the player in question in accordance with the aforementioned Regulations and circular letter no. 826 dated 31 October 2002. Taking into consideration the above, it can be established that the player, Z, has been trained and developed by the Japanese club X between the age of 19 and 21. In accordance with article 5.1 of the Regulations governing the Application of the Regulations for the Status and Transfer of Players, “for the purposes of calculating compensaton, the training period … finishes at the end o the season of his (the player) 21st birthday.” Furthermore, the amount due by the Dutch club Y is to be calculated in accordance with the parameters provided by circular letter 826 dated 31 October 2002, i.e. with an amount corresponding to EUR 60,000 per year of training between the ages of 19 to 21 (corresponding to the club category 2 of X). In this respect, the Chamber noticed that X has erroneously based its calculation on the club category of Y. That is, in accordance with article 7.3 of the Application Regulations and the said circular letter the calculation shall be based on the costs of the country in which the new club is located. Therefore, X being a 2nd category club, the amount of training compensation is obtained by multiplying the amount corresponding to the category of the training club for which the player was registered by the number of years of training from 12 to 21 (cf. art. 7.1 of the Application Regulations) based on the costs of 2nd category clubs in the Netherlands. Consequently, X is entitled to receive training compensation to the total amount of EUR 120,000 (2 seasons x EUR 60,000). The Chamber decided to reject X’s claim for payment of interest and reimbursement of legal fees. i f Decision of the Dispute Resolution Chamber 1. The claim of the Claimant, X, is partially accepted. 2. The Respondent, Y, has to pay the amount of EUR 120,000 to the Claimant. 3. The amount due to the Claimant has to be paid by the Respondent within 30 days as from the date of notification of this decision. 4. If the sum of EUR 120,000 is not paid within the aforementioned deadline, the present matter shall be submitted to the FIFA Disciplinary Committee, so that the necessary disciplinary sanctions may be imposed. 5. According to art. 60 par. 1 of the FIFA Statutes, this decision may be appealed against before the Court of Arbitration for Sport (CAS). The statement of appeal must be sent to the CAS directly within 10 days of receipt of notification of this decision and shall contain all the elements in accordance with point 2 of the directives issued by the CAS, a copy of which we enclose hereto. Within another 10 days following the expiry of the time limit for filing the statement of appeal, the appellant shall file a brief stating the facts and legal arguments giving rise to the appeal with the CAS (cf. point 4 of the directives).
