F.I.F.A. - Camera di Risoluzione delle Controversie (2004-2005) - indennità di formazione - versione non ufficiale by dirittocalcistico - Decisione della Camera di Risoluzione delle Controversie a Zurigo, in Svizzera, il 9 novembre 2004, nella seguente composizione: Slim Aloulou (Tunisia), Presidente Philippe Piat (Francia), gli Philippe Diallo (Francia), gli Stati membri sulla domanda presentata da X Club, come Claiman contro il Club Y, come convenuto in materia di indennità di formazione per il giocatore. Fatti del caso Il giocatore, nato nel 1982, è stato registrato per il club X durante tre stagioni sportive, dalla stagione 1999/2000 fino alla stagione 2001/2002, di età compresa tra 17 e 20. Il 13 agosto 2002, ha firmato un contratto di non-dilettante con pretese del club Y. Club X per l'indennità di formazione dal Club Y, conformemente al capitolo VII del Regolamento FIFA sullo status e sui trasferimenti dei calciatori. Per quanto riguarda la classificazione della squadra X è preoccupato per la stagione 1999/2000, come previsto dalla Circolare 826 del 31 ottobre 2002, apparteneva alla categoria 1. L'importo indicativo per anno per la categoria 1 in Europa è pari a 90.000. Per quanto riguarda la classificazione della squadra X è preoccupato per le stagioni sportive 2000/2001 e 2001/2002, apparteneva alla categoria 2. L'importo indicativo per anno per la categoria 2 in Europa è pari a 60.000. Il club di X richiede la Camera di Risoluzione delle Controversie per passare una decisione nel caso e di ordinare club Y a pagare l'indennità di formazione in conformità al Regolamento FIFA. Il club Y è del parere che non deve pagare un'indennità di formazione per il giocatore in questione al club X in quanto quest'ultimo ha firmato una conferma il 21 giugno 2002 all'attenzione del rappresentante del giocatore con la seguente dicitura: Con la presente confermiamo che il contratto di ... (il giocatore) scade il 30 giugno 2002 e che le indennità di trasferimento non esistono più. Il club di X sostiene che per mezzo di questa conferma, non rinuncia al diritto di risarcimento di formazione per il giocatore in questione conformemente al Regolamento FIFA, ma che ha confermato solo che non somma di trasferimento doveva essere pagato, rispetto alla scadenza del contratto di lavoro. Inoltre, secondo club di X, la persona che ha firmato la suddetta conferma è solo un membro dell'amministrazione e non sarebbe stato in grado di firmare una tale conferma. Considerazioni della Camera di Risoluzione delle Controversie La Camera di Risoluzione delle Controversie della Commissione per lo Status dei Calciatori deve esaminare le controversie rientranti nella propria giurisdizione ai sensi dell'art. 42 del Regolamento FIFA sullo status e sul trasferimento dei giocatori su richiesta di una delle parti della controversia. Ai sensi dell'art. 42,1 acceso. (B) (iv) del Regolamento FIFA sullo status e sul trasferimento dei giocatori, rientra nella competenza della Camera di Risoluzione delle Controversie di esaminare le controversie relative spese di indennità di formazione. Di conseguenza, la Camera di Risoluzione delle Controversie è l'organo competente a decidere sul contenzioso in esame, riguardante la tassa di indennità di formazione sostenuto dal club X. I membri della Camera di Risoluzione delle Controversie sono stati convocati per passare una decisione su tale questione dal presidente ai sensi dell'art. 1 punto 6) del Regolamento prassi e procedure della Camera di Risoluzione delle Controversie. Successivamente, ed entrando nel merito della questione, la Camera di Risoluzione delle Controversie iniziato analizzando il documento datato 21 giugno 2002, firmato a nome del club X, in base al quale, il club Y , che difende l'indennità di formazione non è dovuta Nel caso di specie . A questo proposito, i membri della Camera giunta alla conclusione che tale documento solo detto che nessuna indennità di trasferimento sarebbe dovuto in caso di una futura acquisizione dei diritti federativi del giocatore dopo il 30 giugno 2002 e ha sottolineato che non si è fatto riferimento al diritto di X il club di rivendicare il risarcimento pertinente formazione. Di conseguenza, la Camera ha deciso di affrontare la presente domanda e ha riconosciuto che il giocatore era stato registrato con la X squadra a partire dalla stagione sportiva 1999/2000 fino alla stagione sportiva 2001/2002, vale a dire per tre stagioni sportive, di età compresa tra 17 e 19, e che la presente domanda di risarcimento è stata avanzata dalla parte attrice prima che il giocatore compiuto 23 anni di età. Inoltre, come stabilito nella Circolare n. 826, del 31 ottobre 2002, l'indennità di formazione è dovuta per la formazione sostenute età compresa tra i 12 e 21, se il giocatore non conclude un dilettante contratto prima all'età di 23 anni. Alla luce di quanto sopra, e in particolare tenendo conto del suddetto periodo di soggiorno con l'attore, la Camera ha ritenuto che lo sviluppo positivo del giocatore deve essere in parte attribuita alla formazione e istruzione che ha ricevuto dal club di X. Di conseguenza, è pacifico che club X ha il diritto di ricevere dalla società un'indennità di Y per la formazione e l'educazione del giocatore per quanto riguarda la tempistica che quest'ultimo passato con esso. Ai sensi dell'art. 5.1 del Regolamento dei regolamenti sullo status e il trasferimento dei calciatori, ai fini del calcolo della compensazione, il periodo di formazione pertinente comincia all'inizio della stagione e si conclude alla fine della stagione in questione. Nel caso di specie, la Camera sottolineato che il periodo di formazione importante da prendere in considerazione è andato dalla stagione sportiva 1999/2000 quando il giocatore aveva 17 anni, fino alla stagione sportiva 2001/2002, quando il giocatore aveva 19 anni. In conformità con i principi per il calcolo degli importi di compensazione di allenamento, previsto nel Regolamento FIFA sullo status e sul trasferimento dei giocatori e in particolare, all'art. 7 del Regolamento d'Applicazione del Regolamento sullo status e sul trasferimento dei giocatori così come nella lettera citata circolare, la categoria della società di provenienza e l'importo corrispondente alla stessa categoria nella Confederazione del nuovo club, che è UEFA nel caso di specie, si applicano. In considerazione di quanto sopra, la sezione calcolato gli importi di formazione di compensazione basate sul suo consolidata giurisprudenza e gli importi indicativi elencati nella citata lettera circolare. A questo proposito, la Camera ha preso atto che il club X apparteneva alla categoria 1 in Europa durante la stagione sportiva 1999/2000 e alla categoria 2 durante le stagioni sportive 2000/2001 e 2001/2002. Di conseguenza, 90.000 euro (importo indicativo per anno, per la categoria 1 in Europa) è concesso per la stagione 1999/2000 sportiva, nonché EUR 60.000 (importo indicativo per anno, per la categoria 2 in Europa) per ciascuno dei restanti due stagioni che il giocatore trascorso con il club di X. In conclusione, la Camera di Risoluzione delle Controversie del club ha deciso che Y è tenuto a versare l'importo complessivo di euro 210.000 a Club X per l'indennità di formazione del giocatore. Decisione della Camera di Risoluzione delle Controversie 1. Il Resistente club Y deve pagare l'importo di EUR 210.000 all'attore club di X. 2. L'importo dovuto al club X deve essere pagato dal club Y entro 30 giorni dalla data di notifica della presente decisione. 3. Se il club ha Y non rispetti la suddetta scadenza, un tasso di interesse del 5% all'anno si applica. 4. Tale decisione può essere impugnata dinanzi alla Corte di Arbitrato per lo Sport (CAS), ai sensi dell'art. 60 par. 1 dello Statuto FIFA. La dichiarazione di ricorso deve essere inviato direttamente al CAS entro 10 giorni dal ricevimento della notifica della presente decisione e deve contenere tutti gli elementi di cui al punto 2 delle direttive impartite dal CAS, copia della quale si allega alla presente. Entro altri 10 giorni successivi alla scadenza del termine per la presentazione della dichiarazione di ricorso, la ricorrente deve depositare presso la CAS una breve indicazione dei fatti e argomenti giuridici che danno origine al ricorso (cfr. punto 4 delle direttive). On 13 August 2002, he signed a non-amateur contract with club Y. Club X claims for training compensation from club Y, in accordance with Chapter VII of the FIFA Regulations for the Status and Transfer of Players. As far as the categorisation of club X is concerned for the season 1999/2000, as provided for by the Circular letter 826 dated 31 October 2002, it belonged to category 1. The indicative amount per year for category 1 in Europe is EUR 90,000. As far as the categorisation of club X is concerned for the sporting seasons 2000/2001 and 2001/2002, it belonged to category 2. The indicative amount per year for category 2 in Europe is EUR 60,000. The club X requests the FIFA Dispute Resolution Chamber to pass a decision in the case and to order club Y to pay the training compensation in accordance with the FIFA Regulations. The club Y is of the opinion that it does not have to pay training compensation for the player concerned to club X as the latter signed a confirmation on 21 June 2002 to the attention of the representative of the player with the following wording: We hereby confirm that the contract of … (the player) expires on 30 June 2002 and that no more transfer fees exist. The club X maintains that by means of this confirmation, it did not waive its right for training compensation for the player concerned in accordance to the FIFA Regulations, but that it confirmed only that no transfer sum had to be paid, in respect to the expiry of the employment contract. Furthermore, according to club X, the person who signed the above-mentioned confirmation is only a member of the administration and would not have been in the position to sign such a confirmation. Considerations of the Dispute Resolution Chamber The Dispute Resolution Chamber of the FIFA Players’ Status Committee shall review disputes coming under its jurisdiction pursuant to Art. 42 of the FIFA Regulations for the Status and Transfer of Players at the request of one of the parties to the dispute. In accordance with Art. 42.1 lit. (b) (iv) of the FIFA Regulations for the Status and Transfer of Players, it falls within the purview of the Dispute Resolution Chamber to review disputes concerning training compensation fees. Consequently, the Dispute Resolution Chamber is the competent body to decide on the present litigation concerning the training compensation fee claimed by club X. The members of the Dispute Resolution Chamber were summoned to pass a decision on this matter by the Chairman pursuant to Art. 1 point 6) of the Rules Governing the Practice and Procedures of the Dispute Resolution Chamber. Subsequently, and entering into the substance of the matter, the Dispute Resolution Chamber started by analysing the document dated 21 June 2002, signed on behalf of club X, based on which, the club Y defends that training compensation is not due in the present matter. In this regard, the members of the Chamber reached the conclusion that such document only mentioned that no transfer fee would be due in case of a future acquisition of the player’s federative rights after 30 June 2002 and underlined that no reference was made to the right of the club X to claim the relevant training compensation. As a consequence, the Chamber decided to address the present claim and acknowledged that the player had been registered with the club X from the sporting season 1999/2000 until the sporting season 2001/2002, i.e. for three sporting seasons, between the age of 17 and 19, and that the present claim for compensation was put forward by the Claimant before the player turned 23 years of age. Moreover, as established in Circular letter no. 826, dated 31 October 2002, training compensation is payable for training incurred between the ages of 12 and 21, if the player concludes a non-amateur contract before the age of 23. In light of the above, and particularly taking into consideration the aforementioned period of stay with the Claimant, the Chamber considered that the player’s positive development has to be partially attributed to the training and education that he received from the club X. Consequently, it is undisputed that club X is entitled to receive from club Y compensation for the training and education of the player regarding the timeframe that the latter spent with it. According to Art. 5.1 of the Regulations governing the Regulations for the Status and Transfer of Players, for purposes of calculating compensation, the relevant training period starts at the beginning of the season and ends at the end of the season concerned. In the present matter, the Chamber outlined that the relevant training period to take into consideration went from the sporting season 1999/2000 when the player was 17, until the sporting season 2001/2002, when the player was 19. In accordance with the principles for calculation of the training compensation amounts, stipulated in the FIFA Regulations for the Status and Transfer of Players and particularly, in Art. 7 of the Regulations governing the Application of the Regulations for the Status and Transfer of Players as well as in the aforementioned Circular letter, the category of the former club and the amount corresponding to the same category in the new club’s Confederation which is UEFA in the present case, apply. In view of the above, the Chamber calculated the training compensation amounts based on its well-established jurisprudence and the indicative amounts listed in the aforementioned Circular letter. In this regard, the Chamber took note that club X belonged to Category 1 in Europe during the sporting season 1999/2000 and to Category 2 during the sporting seasons 2000/2001 and 2001/2002. As a consequence, EUR 90,000 (indicative amount per year, for category 1 in Europe) is granted for the 1999/2000 sporting season as well as EUR 60,000 (indicative amount per year, for category 2 in Europe) for each of the remaining two seasons that the player spent with the club X. In conclusion, the Dispute Resolution Chamber decided that club Y is liable to pay the total amount of EUR 210,000 to club X for the training compensation of the player. Decision of the Dispute Resolution Chamber 1. The Respondent club Y has to pay the amount of EUR 210,000 to the Claimant club X. 2. The amount due to club X has to be paid by club Y within 30 days as from the date of notification of this decision. 3. If club Y fails to comply with the above-mentioned deadline, an interest rate of 5% per year will apply. 4. This decision may be appealed before the Court of Arbitration for Sport (CAS) in accordance with art. 60 par. 1 of the FIFA Statutes. The statement of appeal must be sent to the CAS directly within 10 days of receiving notification of this decision and has to contain all elements in accordance with point 2 of the directives issued by the CAS, copy of which we enclose hereto. Within another 10 days following the expiry of the time limit for the filing of the statement of appeal, the appellant shall file with the CAS a brief stating the facts and legal arguments giving rise to the appeal (cf. point 4 of the directives).
