Nel luglio 2002, ha concluso il suo primo non-dilettante contratto con la squadra turca Y, all'età di 22 anni. Il club tedesco X chiede il risarcimento di formazione dal turco squadra Y, secondo la VII Capitolo della rivista regolamento FIFA per il Trasferimento e Status dei Calciatori. Per quanto riguarda la categorizzazione dei club è interessato, come previsto dalla circolare 826 del 31 ottobre 2002, la società tedesca di X è un club di quinta divisione, appartenente alla categoria 4 (importo indicativo di EUR 10.000 all'anno). Il turco del club Y è un club di seconda divisione, appartenente alla categoria 3 (importo indicativo di 30.000 euro all'anno). Il club turco Y non ha inviato la sua posizione alla FIFA nonostante due incitamenti. Considerazioni della Camera di Risoluzione delle Controversie stabilite al capitolo VII della rivista regolamento FIFA per il Trasferimento e Status dei Calciatori, l'indennità di formazione è dovuta per la formazione sostenute età compresa tra i 12 e 21, se il giocatore non conclude un dilettante contratto prima all'età di 23 anni. Nel caso di specie, la Camera sottolineato che il periodo di formazione a prendere in considerazione è andato dalla stagione sportiva 1996/1997 quando la Z giocatore di 15 anni, fino alla stagione sportiva 1997/1998, all'età di 17 anni. Inoltre, la camera ha preso in considerazione il fatto che il giocatore ha concluso il suo primo contratto non dilettante all'età di 22 anni. E 'quindi pacifico che la società tedesca di X ha diritto di ottenere il risarcimento per la formazione e l'educazione della Z giocatore per le due stagioni sportive del giocatore trascorso con il club tedesco. L'importo dovuto da parte del club turco Y deve essere calcolato ai sensi dell'art. 7 del Regolamento d'Applicazione del Regolamento sullo status e il trasferimento dei calciatori così come i parametri previsti dalla circolare n. 826 del 31 ottobre 2002. Ai sensi dell'art. 7 § 3 dei suddetti regolamenti di applicazione, i relativi importi sono determinati gli importi, che si applicano nella confederazione del nuovo club. Su questa base, ai sensi del § 1 del medesimo articolo, l'importo specifico da pagare è determinata in base alla categoria del vecchio club del giocatore. Secondo le suddette circolari, l'importo indicativo di categoria 4 per la Turchia (Europa) è pari a 10.000 per anno di formazione. In considerazione di quanto sopra, la Camera ha deciso di ordinare la Y del club turco a pagare alla società tedesca di X 10.000 euro per anno per la formazione del giocatore Z, vale a dire l'importo totale di euro 20.000. Decisione della Camera di Risoluzione delle Controversie 1. L'affermazione del tedesco Club X è accettata. 2. La squadra turca Y deve pagare l'importo di 20.000 euro al club tedesco X. 3. L'importo dovuto alla società tedesca di X deve essere pagato dal club turco Y entro i prossimi 30 giorni a decorrere dalla data di notifica della presente decisione. 4. Se la somma di cui sopra non viene pagata entro il termine suddetto, la presente questione deve essere presentata alla commissione disciplinare della Fifa, in modo che le necessarie sanzioni disciplinari possono essere imposte. 5. Ai sensi dell'art. 60 par. 1 dello Statuto della FIFA che tale decisione può essere impugnata dinanzi alla Corte di Arbitrato per lo Sport (CAS). La dichiarazione di ricorso deve essere inviato direttamente al CAS entro 10 giorni dal ricevimento della notifica della presente decisione e deve contenere tutti gli elementi di cui al punto 2 delle direttive impartite dal CAS, copia della quale si allega alla presente. Entro altri 10 giorni successivi alla scadenza del termine per la presentazione della dichiarazione di ricorso, la ricorrente deve depositare presso la CAS una breve indicazione dei fatti e argomenti giuridici che danno origine al ricorso (cfr. punto 4 delle direttive). In July 2002, he concluded his first non-amateur contract with the Turkish club Y, at the age of 22. The German club X claims training compensation from the Turkish club Y, in accordance with the Chapter VII of the revised FIFA Regulations for the Transfer and Status of Players. Considerations of the Dispute Resolution Chamber As established in Chapter VII of the revised FIFA Regulations for the Transfer and Status of Players, the training compensation is payable for training incurred between the ages of 12 and 21, if the player concludes a non-amateur contract before the age of 23. In the present case, the Chamber outlined that the training period to take into consideration went from the sporting season 1996/1997 when the player Z was 15, until the sporting season 1997/1998, at the age of 17. Furthermore, the chamber took into consideration that the player concluded his first non-amateur contract at the age of 22. It is therefore undisputed that the German club X is entitled to receive compensation for the training and education of the player Z for the two sporting seasons the player spent with the German club. The amount due by the Turkish club Y is to be calculated in accordance with Art. 7 of the Regulations governing the Application of the Regulations for the Status and Transfer of Players as well as the parameters provided by the Circular letter no. 826 dated 31 October 2002. According to Art. 7 § 3 of the above-mentioned Application Regulations, the relevant amounts are determined by the amounts, which apply in the confederation of the new club. On this basis, according to § 1 of the same article, the specific amount to pay is determined by the category of the player’s old club. According to the above-mentioned Circular, the indicative amount of Category 4 for Turkey (Europe) is EUR 10,000 per year of training. In view of the above, the Chamber decided to order the Turkish club Y to pay to the German club X EUR 10,000 per year for training the player Z, i.e. the total amount of EUR 20.000. Decision of the Dispute Resolution Chamber 1. The claim of the German club X is accepted. 2. The Turkish club Y has to pay the amount of EUR 20,000 to the German club X. 3. The amount due to the German club X has to be paid by the Turkish club Y within the next 30 days as from the date of notification of this decision. 4. If the aforementioned sum is not paid within the aforementioned deadline, the present matter shall be submitted to FIFA’s Disciplinary Committee, so that the necessary disciplinary sanctions may be imposed. 5. According to art. 60 par. 1 of the FIFA Statutes this decision may be appealed before the Court of Arbitration for Sport (CAS). The statement of appeal must be sent to the CAS directly within 10 days of receiving notification of this decision and has to contain all elements in accordance with point 2 of the directives issued by the CAS, copy of which we enclose hereto. Within another 10 days following the expiry of the time limit for the filing of the statement of appeal, the appellant shall file with the CAS a brief stating the facts and legal arguments giving rise to the appeal (cf. point 4 of the directives).
